TERMS OF SERVICE

These Terms of Service govern access to and use of www.budachrome.com and the purchase of products and services from Budachrome Korlátolt Felelősségű Társaság. By submitting an order, the customer accepts the version of these Terms in force at the time of the order.

2. SCOPE AND DEFINITIONS
These Terms apply to products and services made available by Budachrome through the online store, including photographic film, accessories, film development, scanning and related laboratory services.
“Customer” means any person or organisation using the website or placing an order.
“Consumer” means a natural person acting for purposes outside that person’s trade, business, craft or profession.
“Business customer” means a person or organisation acting in the course of a trade, business, craft or profession.
Mandatory consumer rights apply only where the customer qualifies as a consumer and cannot be excluded by contract.
3. USE OF THE WEBSITE
The customer may use the website only for lawful purposes and in accordance with these Terms. A customer must have the legal capacity required to enter into the relevant contract. A minor may place an order only with the involvement and approval of a parent or legal guardian where required by law.
Budachrome may refuse access, suspend an account or cancel an order where reasonably necessary to prevent fraud, abuse, security incidents, unlawful activity or material breach of these Terms.
4. ELECTRONIC CONTRACTING PROCESS
The main technical steps for placing an order are:
1. select the product or service and the available options;
2. add the item to the cart;
3. review and, if necessary, modify the cart;
4. enter or confirm customer, billing, delivery and contact information;
5. select the available delivery and payment method;
6. review the order summary, prices and these Terms;
7. correct any data-entry error before submission;
8. submit the order using the button indicating a payment or ordering obligation.
The customer can identify and correct data-entry errors through the cart and checkout pages before submitting the order. After submission, the customer should contact Budachrome immediately if a correction is required. A correction might no longer be possible after fulfilment or dispatch has begun.
By submitting the order, the customer makes a binding offer to purchase the selected products or services. The automated order email confirms receipt of the order and does not necessarily constitute final acceptance. The contract is concluded when Budachrome expressly accepts the order, sends a fulfilment or ready-for-processing confirmation, or begins performance, whichever occurs first.
Budachrome acknowledges receipt electronically without undue delay. If no electronic confirmation of receipt reaches the customer within 48 hours, the customer is released from the offer or contractual obligation as provided by applicable law.
The electronic contract is not treated as a separately filed written contract under Hungarian law. Order information and communications are stored electronically in accordance with legal and accounting obligations and may be accessible through the customer account or order confirmation. The customer should save or print these Terms and the order confirmation.
Contracts may be concluded in Hungarian or English, according to the language selected in the store. Budachrome is not subject to a separate voluntary code of conduct unless expressly indicated on the website.
5. PRODUCT AND SERVICE INFORMATION
Budachrome makes reasonable efforts to describe products and services accurately. Photographs, colours, packaging, batches, technical characteristics and availability may change or may appear differently depending on the display, device, production run or film stock.
Product descriptions, processing instructions and compatibility information form part of the contract. Customers must review these details, including film format, ISO, process, remjet or other processing requirements, before ordering.
Where a product or service is unavailable after an order is placed, Budachrome will inform the customer and refund any amount paid for the unavailable item. Budachrome may offer an alternative, but the customer is not required to accept it.
6. PRICES, TAXES AND PAYMENT
The applicable price, currency, tax treatment, delivery charge and total amount are displayed before the customer submits the order. Consumer prices include applicable value-added tax where required. Any delivery charge is added before final submission.
Online payments are processed through Shopify Payments. Depending on device, location and eligibility, the available methods may include supported payment cards, Shop Pay, Apple Pay and Google Pay. Budachrome does not receive or store complete payment-card details.
The payment is subject to authorisation by the payment provider. Budachrome may delay fulfilment until payment has been successfully authorised or received.
Invoices are issued through Billingo using the billing information provided by the customer. The customer is responsible for ensuring that the billing name, address and tax information are accurate before submitting the order.
7. ORDER ACCEPTANCE, AVAILABILITY AND CANCELLATION BY BUDACHROME
Budachrome may refuse or cancel an order before performance where there is a reasonable reason, including:
• an obvious pricing, product-information or technical error;
• lack of stock or inability to perform the service;
• failed or suspected fraudulent payment;
• unlawful or prohibited use;
• a delivery restriction;
• a material error in the customer’s details;
• a request that cannot be performed safely, lawfully or with the selected process.
If Budachrome cancels an order after payment, the affected amount is refunded without undue delay using the original payment method unless another method is agreed.
Budachrome may apply reasonable purchase limits to limited-stock products, reseller orders or promotional offers, provided that this does not unlawfully discriminate against customers.
8. CUSTOMER ACCOUNTS AND GUEST CHECKOUT
A customer account may be offered but is not required where guest checkout is available. Customers are responsible for providing accurate information and protecting their account access and email account.
The customer must inform Budachrome promptly if unauthorised use or a security incident is suspected. Budachrome may suspend an account where reasonably necessary for security or legal compliance.
Order, account and personal data are handled in accordance with the Privacy Policy.
9. DELIVERY AND PERSONAL COLLECTION
Delivery methods, fees, destination availability and estimated times are displayed at checkout and are further described in the Shipping Policy.
Personal collection is available at 1111 Budapest, Bartók Béla út 42., Hungary, only after the customer has received confirmation that the order is ready.
The customer must provide accurate delivery and contact information and must collect locker or collection-point parcels within the carrier’s deadline. Additional costs caused by incorrect data or non-collection may be charged to the customer where permitted by law and where the failure is not attributable to Budachrome or the carrier.
10. FILM DEVELOPMENT AND SCANNING SERVICES
10.1 Customer instructions
The customer must select the correct film format, development process, scan option and any other service requirement. If instructions are incomplete, inconsistent or appear unsuitable for the submitted film, Budachrome may contact the customer, use a reasonable standard setting, place the order on hold or refuse the requested process where necessary to prevent damage.
10.2 Commencement during the cancellation period
Where a consumer requests performance of a laboratory service before expiry of the statutory 14-day cancellation period, Budachrome may require a separate express request and an acknowledgement that the right to cancel is lost once the service is fully performed. If the consumer cancels after performance has begun but before completion, the consumer must pay the proportionate value of the work already performed as provided by law.
10.3 Irreversible processing
Film development is inherently irreversible. The film may be removed from its cartridge, cut, chemically processed, washed, dried and scanned. It cannot be returned to its original unprocessed state after these steps begin.
10.4 Characteristics and factors outside Budachrome’s control
Budachrome performs laboratory work with professional care. Results may nevertheless be affected by the film’s age, manufacturing or latent defects, storage, heat, moisture, radiation, camera condition, pressure plate, film transport, light leaks, exposure, loading, unloading, prior handling, contamination, scratches existing before submission, customer-selected chemistry, cross-processing and the inherent characteristics of the film stock.
Colour, density, grain, contrast, sharpness, frame position and scan appearance may vary according to the material, exposure, process and scanner settings. A result caused by a factor outside Budachrome’s control is not necessarily defective performance. Mandatory rights remain available for an error attributable to Budachrome.
10.5 Customer content and authority
The customer represents that the customer is entitled to submit the film or other material for processing and that the requested service does not knowingly require Budachrome to participate in unlawful conduct or infringement of third-party rights.
Budachrome does not routinely inspect images for content and does not use customer images for unrelated purposes. If material appears manifestly unlawful or creates a serious safety or legal risk, Budachrome may suspend processing and act as required by law.
10.6 Digital scans
WeTransfer download links remain available for 60 days. Budachrome stores digital image files on its own server for 90 days. Customers must download and back up their files within these periods. After expiry, the files may be permanently deleted and might not be recoverable.
10.7 Physical negatives
Budachrome guarantees retention of physical negatives for 90 days from the notification that the completed order is ready. After that period, continued storage is not guaranteed and Budachrome may securely destroy the negatives unless a different period was agreed in advance.
11. RETURNS, WITHDRAWAL AND REFUNDS
Consumer withdrawal, service cancellation, return costs, refunds and statutory exceptions are described in the Return and Refund Policy.
A business customer has no statutory 14-day consumer withdrawal right. A business order may be cancelled or returned only where required by law or agreed by Budachrome in writing.
12. CONFORMITY, WARRANTY AND DEFECTIVE PERFORMANCE
Budachrome is responsible for defective performance in accordance with applicable law. Consumer rights may include repair or replacement, a proportionate reduction of the price, termination of the contract or another remedy provided by law, depending on the nature of the product or service and the circumstances.
For consumer sales of goods, statutory conformity claims may generally be exercised within two years from performance, subject to the applicable legal conditions. A defect communicated within two months after discovery is treated as having been communicated without delay. Product-warranty and mandatory-guarantee rights apply where their legal conditions are met.
These rights are separate from and are not limited by any voluntary return policy.

A verbal complaint is examined promptly and remedied immediately where possible. If a verbal complaint cannot be resolved immediately, or the customer disagrees with the handling, Budachrome records it as required by law.
Written consumer complaints are answered in writing, with reasons where rejected, within 30 days of receipt. Complaint records and responses are retained for the period required by law.
Before applying to a conciliation body, the consumer must attempt to resolve the dispute directly with Budachrome.
14. ALTERNATIVE DISPUTE RESOLUTION
The consumer may apply to the conciliation body competent according to the consumer’s residence or stay. The body associated with Budachrome’s registered office is:

Budachrome cooperates in the proceeding as required by law. The consumer may also contact the competent consumer-protection authority or bring a claim before a court.
15. USER-GENERATED AND SOCIAL-MEDIA CONTENT
If a customer sends a review, comment, photograph or other content intended for publication, the customer confirms that the customer has the necessary rights and permissions. Publication occurs only where the purpose and permission are clear.
Copyright in customer photographs remains with the author or rights holder. Submission for laboratory processing does not grant Budachrome a promotional licence.
Where Budachrome wishes to repost a publicly shared Instagram, Facebook or other social-media post, it will request permission from the relevant creator where required. The permission applies only to the use communicated or agreed and may be subject to separate campaign terms.
Budachrome may remove or decline content that is unlawful, infringing, misleading, abusive, discriminatory, obscene, malicious, technically harmful or unrelated to the intended function.
16. PROHIBITED USE
The website and services must not be used to:
• violate law or third-party rights;
• submit fraudulent orders or payment information;
• interfere with website security or operation;
• introduce malicious code or attempt unauthorised access;
• scrape, copy or commercially exploit website content without permission;
• harass staff or other users;
• submit material that the customer is not entitled to have processed.
Budachrome may take proportionate measures, including refusing service, suspending an account and notifying a competent authority where required by law.
17. INTELLECTUAL PROPERTY
The website, Budachrome brand, visual identity, text, graphics, product presentation, photographs, video and software elements are protected by intellectual-property law and may be used only as permitted by law or with prior written permission.
Third-party trademarks, including names associated with film stocks, payment, delivery and technology services, belong to their respective owners. Reference to them does not imply manufacture, sponsorship or endorsement unless expressly stated.
18. THIRD-PARTY SERVICES
The store relies on third-party services, including Shopify, Shopify Payments, Billingo, delivery providers, WeTransfer, Meta services and website applications. Their availability and independent processing are subject to their own terms and privacy notices.
Budachrome remains responsible for its own contractual obligations and does not exclude any responsibility that cannot lawfully be excluded merely because a third-party provider is involved.
19. WEBSITE AVAILABILITY AND FORCE MAJEURE
Budachrome may update, maintain, suspend or modify parts of the website where reasonably necessary. Temporary interruption may occur because of maintenance, security, carrier disruption, network or power failure, equipment failure, shortage of materials, governmental measures, extreme weather or another circumstance beyond reasonable control.
Budachrome will use reasonable efforts to limit disruption and inform customers of material effects on active orders. Mandatory rights relating to delay, non-performance and refunds remain unaffected.
20. LIABILITY
Budachrome is liable in accordance with applicable law. Nothing in these Terms excludes or limits liability for intentional conduct, gross negligence, injury to life, body or health, defective products where liability is mandatory, or any other liability that cannot lawfully be excluded or limited.
To the extent permitted by law, Budachrome is not responsible for loss caused solely by inaccurate customer instructions, pre-existing film defects, customer equipment, unauthorised third-party conduct, a carrier before Budachrome receives customer-supplied film, or another circumstance outside Budachrome’s reasonable control.
A consumer’s mandatory rights are not restricted by this section.
21. PRIVACY AND COOKIES
Personal data is processed in accordance with the Privacy Policy. Cookies and similar technologies are managed through the website’s cookie banner and cookie-settings interface.
22. CHANGES TO THESE TERMS
Budachrome may amend these Terms for future contracts to reflect legal, technical or operational changes. The version applicable to an order is the version made available when the order is submitted, unless a change is required by mandatory law or expressly accepted by the customer.
23. SEVERABILITY AND WAIVER
If any provision is invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision on one occasion does not constitute a general waiver of that provision.
24. GOVERNING LAW AND JURISDICTION
These Terms and the contracts governed by them are subject to Hungarian law. This choice does not deprive a consumer of mandatory protection granted by the law of the consumer’s habitual residence where applicable.
Consumers may bring claims before a court having jurisdiction under mandatory law. For disputes with business customers, the competent Hungarian courts have jurisdiction unless the parties validly agree otherwise in writing.
Hungarian and English versions are intended to have equivalent meaning. In the event of a discrepancy, the Hungarian version is used for interpretation to the extent permitted by mandatory law.
